This document regulates the use and access to ArquiBOOX http://www.arquiboox.com (hereinafter "ArquiBOOX"), the provision of services carried out through this website and the responsibilities arising from their use.

First .- IDENTIFICATION DATA OF THE OWNER

The company owner of ArquiBOOX is SOUTH WING CONSULTING, SL, with CIF B-86032786, located in Paseo de la Habana 26, 7 º 12, 28036 Madrid, registered in the Mercantile Registry of Madrid, Volume 28086, Folio 179, Section 8, Sheet M-506 089 (hereinafter "SWC").

Second .- USER

Access and/or use of ArquiBOOX confers the status of USER, making applicable to the USER these General Terms of Use. For this purpose, it is understood that mere access or use of ArquiBOOX by the USER, implies full adherence to each and every one of the conditions published in ArquiBOOX, without any reservation, at the time of such access and/or use, as well as to the Privacy Policy of ArquiBOOX.

However, SWC may establish special conditions regulating the use of specific services and content offered to USERs at and/or through ArquiBOOX. Where appropriate, these special conditions shall substitute, complete and/or modify the Terms of Use.

Third .- GENERAL TERMS OF USE

3.1 .- The USER assumes responsibility for the use he/she makes of ArquiBOOX. The USER undertakes to make proper use of the content and services offered through it by SWC. In this regard, by way of example but not limitation, the USER agrees not to use them for (i) engaging in illegal activities, illegal or contrary to good faith and public order, (ii) causing damage to physical and logical systems of SWC, its suppliers or third parties, (iii) introducing or spreading computer viruses or any other hardware or software capable of causing any damage.

3.2 .- In the event that through ArquiBOOX the USER could participate in chats, forums or other means available to them for active participation in ArquiBOOX, it is expressly forbidden that the USER, through such media, performs demonstrations resulting in attempts against fundamental rights and freedoms. SWC reserves the right to remove any of the USER´s input that violates the above prohibition or that is considered by SWC not suitable for broadcast on the Internet. SWC will in no case be responsible for the contents disposed in ArquiBOOX by the USER.

Fourth .- INTELLECTUAL PROPERTY

Both ArquiBOOX and the contents accessible to the USER through ArquiBOOX are owned by SWC without damage or violation of any rights that may correspond to the companies included in the directory of ArquiBOOX. The USER undertakes to respect all intellectual property rights, industrial rights or other rights that correspond to SWC or third parties.
  
Fifth .- LINKS AND COOKIES

5.1 .- Links to ArquiBOOX

The USER who wants to introduce links to ArquiBOOX from their own websites shall comply with the conditions listed below:

- The link will only connect to the home or main page of ArquiBOOX but shall not reproduce it in any form (online links, copy of text, graphics, etc).

- It is forbidden to establish frames of any kind that envolve ArquiBOOX or allow viewing its content via other websites. In any case, this prohibition also extends to allowing content of ArquiBOOX to be viewed together with external content, so that: (i) it causes confusion or misleading to USERS about the true origin of the contents, (ii) it constitutes an act of comparison or unfair imitation, (iii) it serves to take advantage of the reputation of the brand and the prestige of SWC, or (iv) it is in any way prohibited by applicable law or it violates the customs of good craftsmanship that are generally accepted on the Internet.

- It shall not be made from the webpage that introduces the link any false, inaccurate or incorrect manifestation about ArquiBOOX or SWC, its partners, employees, customers or the quality of the services it provides.

- Under no circumstances shall be expressed on the webpage where the link is located that SWC has given its consent to the inclusion of the link or otherwise sponsors, collaborates, verifies or supervises the services of the sender.

- The webpage containing the link shall comply with the law and may not under any circumstances provide or link to content of its own or third parties that is unlawful or contrary to morals and good customs or that is inappropriate or in conflict with the activity of SWC.

5.2 .- Links to other websites

In ArquiBOOX, the USER can find links to other websites through different buttons, links, banners, etc., which are managed by third parties. SWC offers these possibilities to the USER with a commercial purpose or to provide access to other information available on the Internet on any topic related to ArquiBOOX, but independent of it.

SWC does not control or endorse the information, content, products or services provided by other sites linked from ArquiBOOX. SWC assumes no responsibility for any aspect of the web to which it establishes a link, in particular, by way of example and not limitation, its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its content in general.

The establishment of a link from any part of ArquiBOOX to another website does not necessarily mean that there is any kind of relationship, collaboration or dependency between SWC and the party responsible of the website.

5.3 .- Services provided by third parties through ArquiBOOX

If ArquiBOOX offers services provided by third parties or for which SWC only acts as mercantile agent, broker or partner, SWC does not guarantee the legality, reliability and usefulness of them.

SWC is not liable for damages of any kind caused by the services provided by third parties through this website, and in particular, without limitation, those caused by:

• Failure to comply with the law, morality or public order
• The incorporation of virus or any other computer code, files or programs that may damage, interrupt or impede the normal operation of any computer software or hardware or telecommunications equipment.
• The infringement of intellectual property, trade secrets, or contractual commitments of any kind.
• The performance of acts that constitute illicit, deceitful or unfair publicity and, in general, constitute unfair competition.
• The lack of truthfulness, accuracy, quality, relevance and/or timeliness of the content transmitted, distributed, stored, received, obtained, made available or accessible
• The violation of the rights of honor, personal and family privacy and image of persons or, in general, any third party rights.
• The failure, delay in performance, defective performance or termination for any reason of the obligations assumed by third parties and contracts with third parties.

5.4 Use of cookies
The USER accepts the use of cookies and IP tracking. The traffic analyzer of the site uses cookies and IP tracking to collect data for statistical purposes such as date of first visit, number of visits, date of last visit, URL and domain from which it comes, browser used and screen resolution. However, USERS can disable and/or remove cookies by following the instructions of their browser.

Sixth .- REGISTRATION

6.1 .- The USER can access ArquiBOOX freely and at no cost, although he/she can register on the site to access certain services or information. The USER wishing to register must complete the registration process by providing current, complete and accurate information as requested in the application forms accordingly. Then he/she can select a USER name and password.
  
6.2 .- The USER undertakes to make keep the password to access these services secret. The USER is responsible for costs and damages caused by the use of services by any third party who uses his/her password to that effect by a careless use or loss of it by the USER.
 
The USER has the obligation to notify any unauthorized use of any password or services, or any other breach of security rules, when having knowledge of it.

Seventh .- RESPONSIBILITY

Acceptance of these General Conditions implies the USER's compliance with the use of the services at his/her own risk.

SWC does not guarantee:

• The provision of the services provided through ArquiBOOX.
• The continuity of the services of the website.
• The absence of errors in these services and the correction of any defects that may occur.
• The absence of viruses and/or other harmful components in ArquiBOOX or the server that supplies it.
• The invulnerability of ArquiBOOX and/or the infallibility of the security measures taken.

In addition, SWC will not be responsible for:

• The lack of use or performance of ArquiBOOX or of the software used, distributed or obtained from this website.
• The loss of data or services resulting from any delay, non-deliveries, wrong delivery of products or service interruption.
• The accuracy, reliability, quality or nature of information obtained through its services or through ArquiBOOX reflected in any way, including any content owned by third parties.
• The consequences arising out of or related to any virus that is transmitted through its servers.

SWC will not be liable at any time for any losses or damages, including, without restriction, any lost profits, lost profits or damages, direct or indirect, mediating even advised of the possibility of such damages, arising from or relating in any way with this ArquiBOOX.

Eighth .- MODIFICATION OF THE TERMS OF USE
 
8.1 .- SWC has the right to modify these terms and conditions unilaterally, in whole or in part without prior notice, announcing any change in the same way as in these general conditions or through any communication addressed to the USER. The validity of these general conditions coincides therefore with time of exposure until the time they are modified in whole or in part. SWC may terminate, suspend or terminate unilaterally, without notice, the service delivery site and/or any services, without the possibility for the USER to require any compensation. Upon such termination, the USER must destroy any material obtained from ArquiBOOX, including all software and documentation and any copy, print and installation.

8.2 .- SWC reserves the right to make unannounced changes it deems appropriate in ArquiBOOX, and may change, delete or add content and services provided or the way they are presented or located in ArquiBOOX.

Ninth .- APPLICABLE LAW AND JURISDICTION

9.1 .- These General Terms of Use and the Privacy Policy shall be governed by Spanish law.

9.2 .- The parties, expressly waiving their own jurisdiction, subject all interpretations and conflicts that could arise from these general conditions to the Courts of Madrid.

The USER expressly declares to be aware of the content of these Terms of Use and to accept all obligations imposed by them.
